Associate Attorney Job Description

A trusts and estates attorney handles matters relating primarily to probate, inheritance, trusts and estates law. Trusts and estates legal work also often includes aspects of family law, taxation law, business law, real property law, inheritance law and probate law, as well as questions of conservatorship, guardianship, community property laws, joint ownership and charitable gifting.

Overview of Position:  The associate attorney would primarily be responsible for transactional estate planning legal work, including meeting with and counseling clients to implement a plan for incapacity and death, and drafting appropriate documents including wills, revocable living trusts, powers of attorney, and health care directives.  The associate may also need to counsel clients with respect to estate, gift, and income tax matters, and explain the Firm’s approach to engagements and fees. The associate would also be responsible for legal work related to trust administration and probate matters, including advising trustees and executors, handling court appearances and providing guidance on asset management and distribution.

Reporting Relationship:  Reports to the Office Manager for administrative functions and to the Managing Attorney for legal functions.

Full Time:  40 hours / week

Duties and Responsibilities:  The associate will be expected to perform a wide variety of functions to support the Firm’s trust and estates practice, including:

  • Client Contact – Communicate with clients in person and via mail, email and telephone to commence an engagement, to keep the matter moving forward on a timely basis, and to make certain that the efforts of the Firm’s support staff are aligned with the client’s needs.

  • Third Party Contact – Communicate with opposing counsel, financial advisors, insurance agents and companies, accountants, other members of the client’s “team” when authorized to do so by the client as may be necessary to complete the engagement.

  • Problem Solving / Initiative – Proactively anticipate and resolve legal issues quickly.   

  • Delegation – Delegate tasks to support staff when appropriate, yet maintain direct client contact to ensure the client is satisfied with the progress on the matter and the attorney’s involvement.

  • Draft Documents – Prepare drafting instructions for the support staff or prepare the initial draft of documents.

  • Continuing Education – Attend CLE programming, review daily and weekly legal updates, and other Firm education opportunities to consistently increase competence. The Firm has extremely high expectations regarding continuing education.

  • Process Improvement – Make recommendations to improve Firm processes that will increase service quality and efficiency and responsiveness to clients.

  • Marketing – Participate in firms marketing activities, including public speaking engagements, writing articles and blog posts, leading CLE seminars and client workshops, attending or leading public education events and other activities.

  • Firm Policies and Procedures – Adhere to firm policies and procedures.

  • Other Duties – Perform other duties as assigned.

Qualifications & Skills:

  • J.D. degree required and must be a member in good standing with the State Bar of California. Additional licensure or education, such as LLM, MBA, or CPA is helpful but not required.

  • Two or more years of relevant work experience.

  • Excellent oral and written communication skills.

  • Attention to detail, superior organizational skills, and ability to prioritize tasks.

  • Demonstrated experience with, or demonstrated ability to quickly learn, relevant Firm software programs.  The Firm uses all Apple-based computers and devices, and cloud-based software, including custom software built specifically for the Firm.  The Firm is exceptionally technology-oriented.

  • Ability to anticipate the client’s needs and the Firm’s needs.
